Yea, they forgot to protect it. The band hasn't seen it yet, so it needs their approval. I think they will be fine with it, you just may have to wait a few weeks to see it.

Would've thought it to be the other way around. Ask the band first if it is okay to use the song to make a video? Then put all the resources into it.
