Not sure, was this a John Yates design, as per tons of other Alternative Tentacles artwork?  If so, 'lifting' is what he does best.

CD art direction and design are credited to: Mackie Osborne with constant interference from JB & Buzzo.

But I'm guessing you are referring to the t-shirt version, which likely has the same originators.

It's called stock photography.  Look into it.

Since this is clearly a painting by someone else they used for the booklet, I wouldn't call it photography. And as far as I'm concerned, they can lift as much as they want, as long the copyright holders get their fair share. Buzzo is the last person I would accuse of being a blatant thief.
