Because you lose a lot with mp3 compression, particularly in the high end frequencies.  There is a reason why a 5 minute wav file will be 50mb and a 5 minute mp3 at 192kbs will be like 5 mb, that's a lot of information lost.  Sure, you get the idea, but it's far from the full sound intended and recorded.

I was just about to type this.  My friend downloaded The Maggot the other day and after hearing the cd for years the mp3s just didn't cut it.  It felt like I was listening to it on the radio except it sounded a little bit better.  I feel the same way about Nude With Boots.  The production is fine but the mp3s make it sound like fm radio.

Why did I even download it?  Because I'm impatient as hell and the Melvins are my favorite band.  Is it technically even illegal now that I have it preordered?

I understand what you're saying, but I seriously doubt if I've ever listened to something the way it was intended and recorded, and I really mean that. I listen with my own concentration, and might not hear things that Toshi went apeshit over in the studio. And what the hell, as long as I don't hear it and enjoy, I don't miss anything.

If MP3s are encoded with the right codec, and at the right bitrate, the sound difference between CD and MP3 is negligible.  The high-frequency cutoff is a side effect of poor digital mastering, though that's arguable.  Most CDs nowadays are digitally mastered louder than they used to be, and there is a smaller difference between loud and quiet, and frequencies above a certain point are cut off.

The CD will sound exactly the same as the leaked rip, unless it was an unmastered or pre-master or something.  The conversion to MP3 won't cause a big enough difference to be noticed, unless the person who did the rip is inexperienced.  I ripped all of my Melvins CDs to my harddrive, and they sound the exact same when played through the same sound system, using the same computer software.
